House and Bathing Rules
§ 1 General information
By acquiring access rights or, in the case of holders of season and annual tickets, by entering the beach resort, each bather acknowledges the House and Bathing Rules and all other regulations intended to maintain operational safety.
§ 2 Admission
- Children under 8 years must be accompanied by a chaperone. Persons who are vulnerable or who require assistance due to a severe physical or mental handicap may only enter the beach resort if accompanied by a chaperone. This also applies to persons prone to seizures or fainting.
- Persons who, on account of the specific circumstances of the individual case, are suspected of potentially breaching the following House and Bathing Rules, may be denied access. This also applies to persons under the influence of alcohol or other intoxicating substances.
- Animals are not permitted in the beach resort.
§ 3 Opening hours and swimming times
- The use of the bathing area is limited to the opening hours of the beach resort, which are determined by the operator. The opening hours are posted in the entrance area of the beach resort and published on its website (www.strandbad-gifiz.de). The water must be vacated 30 minutes before the resort closes. The closing times are based on the time of leaving the building. Unless otherwise posted in the entrance area of the beach resort or published on its website, the last admission shall be 90 minutes before the closure of the beach resort.
- The operator reserves the right to restrict, in full or in part, the services and opening hours offered by the beach resort, e.g. in the event of operational disruptions, refurbishments, inspections, weather-related closures, events, school or club swimming events. No claims may be derived in connection therewith.
§ 4 Pool conduct
- Bathers are obliged to treat the areas, facilities and property of the beach resort with due care and respect and not to contaminate them. In addition, bathers must behave appropriately towards other bathers and respect their sense of decency.
- The signposted warnings and behavioural instructions must be observed. The same applies to any requests by employees and other assistants.
- Non-swimmers may only swim in the non-swimmers' area and must be accompanied and supervised in the water.
- As a general rule, only one person is allowed inside each changing cubicle. Exceptions include persons in need of assistance, such as infants or persons with disabilities.
- The consumption of alcohol must be kept to an acceptable level; this is the responsibility of each bather.
§ 5 Entrance tickets
- The fee chart forms part of these House and Bathing Rules.
- Every bather must have a valid admission ticket (e.g. cash receipt) and show it to the beach resort staff on request. Upon leaving the resort, a day pass will generally cease to be valid and does not entitle you to re-enter the resort. Exceptions may be granted in individual cases, in particular if leaving the resort for a short time. These must be discussed with the staff before leaving the resort.
- Admission tickets and receipts issued are personalised and may only be used by the purchaser or a nominated person (e.g. if the annual ticket is given as a gift). It is not permitted to make the admission ticket available for use by another bather for a fee or free of charge, or to have the annual ticket of another bather made available for use.
- Access to the beach resort is only permitted during opening hours and only for persons with valid access rights.
- Technical or operational disruptions (e.g. non-usability of the slide or issues with the showers) generally do not entitle the holder to reclaim or subsequently reduce the entrance fee.
§ 6 Restrictions
- Leaving the supervised bathing area is prohibited. Bathing supervision only takes place in the designated and supervised bathing area and only during the opening hours.
- Jumping in, pushing in or throwing other persons into the lake is prohibited because of the dangers involved.
- Smoking is completely prohibited in all indoor areas, including e-cigarettes. Smoking is permitted outdoors, the ashtrays provided should be used for the disposal of cigarette butts. Smoking of hookahs/shisha is prohibited both indoors and outdoors.
- It is forbidden for bathers to engage in sexual acts by themselves or with other bathers in the beach resort or to have sexual acts performed on them by other bathers.
- Unless authorised to do so in writing, bathers are not allowed to:
a. Display or distribute advertising brochures, flyers, printed materials or similar;
b. Perform actions intended to serve one's own commercial interests or those of a third party;
c. Hold or call meetings;
d. Take actions aimed at disseminating political, religious or philosophical beliefs or for political decision-making;
e. Carry out signature or fundraising campaigns. - Photographing and filming is only permitted with prior approval of the operator.
- The wearing of clothing/swimwear is mandatory at all times, naked bathing or sunbathing is prohibited. Women are not permitted to swim or sunbathe topless.
§ 7 Liability
- The operator is liable in accordance with the statutory provisions for damage to life, limb or health that is based on a culpable breach of duty by the operator, its legal representatives or its vicarious agents.
- The liability for damages that are based on a violation of essential contractual obligations is limited to the compensation of the foreseeable typically occurring damage. Material contractual obligations are those which arise due to the nature of the contract and whose non-compliance would endanger the purpose of the contract.
- The operator is neither liable for force majeure or happenstance, nor for defects that may occur even upon exercising due diligence or which have not been identified.
- In the event of misuse or damage to the facilities, the bather shall be liable for damages as per legislation.
- The operator shall only be liable in the event of wilful intent or gross negligence for the loss of valuables, cash or clothing. This also applies to damage to items by third parties.
- The provision of a locker and/or safe deposit does not form an obligation to adequately secure items. When using lockers and deposit boxes, it is the responsibility of the bather to lock them, to check the secure closure of the respective devices and to store any keys carefully.
- In the event of loss of access to the lockers or deposit box keys, a lump sum will be charged for opening the key by means of a master key and for obtaining the key again. In addition, if the operator's on-call service has to come out, the lump sum shall be increased in accordance with the operating costs. The various amounts are listed in the price list.
- Before a deposit box or locker is opened by the beach resort staff and the contents handed over, the bather/recipient of the contents must leave his/her personal details in writing and confirm receipt with his/her signature.
§ 8 Duty of supervision
- The obligation to supervise a child/children is the responsibility of the parents or guardians of the children and is not waived by the fact that the operator employs personnel in the context of its public safety obligation to recognise and ward off dangers. Parents/guardians are responsible for ensuring that their children do not violate the House and Bathing Rules during their stay at the beach resort.
- The obligations set out in paragraph 1 above also apply to those persons to whom a child has been entrusted during the visit to the beach resort.
- Any liability of the operator according to § 7 is not affected by the above regulations.
§ 9 Lost property
Lost property should be handed to a staff member and is kept for one month. Valuable items will be subject to legal provisions.
§ 10 Violations of the House and Bathing Rules
- In the event of violations of the House and Bathing Rules, the bather may be expelled from the beach resort, taking into account all the circumstances of the specific case, in particular the nature and severity of the violation and the severity of its consequences, and be held liable for any consequences and costs of his/her misconduct.
- If there is a risk that a bather will in future violate the House and Bathing Rules on the basis of objective facts, the staff of the beach resort are entitled to issue a house ban, taking into account all the circumstances of the individual case. The duration of the house ban will be determined at our discretion. The legal rights and claims of the bather shall remain unaffected.
- In the event of a suspected violation of the House and Bathing Rules by a bather on the basis of concrete facts, the beach resort staff are authorised to obtain personal details about the bather. The bather is obliged to provide his/her personal details (surname, first name, official address) and to identify himself/herself by means of suitable documents (identity card, driver's license). Copies of the documents will not be made.

This is particularly the case if this information is required to assert legal claims.

Children over 1 metre in height, pupils, students up to the age of 27, OffenburgCard holders and severely disabled people (min. 50% degree of disability).

The family tariff applies to all single parents or parents with up to three children (up to the age of 18), provided they live in the same household. Families with more than three children can use the family ticket upon presentation of the Landesfamilienpass or the children’s and parent’s ID cards.
